Perceptual Maps in Marketing Simulation Summary Essay

Perceptual maps help to improve a company’s current product on the market by mapping consumer expectation of the product. The motorcycle company Thorr Motors perceptual maps were used to create a marketing plan to aid in maintaining a high brand image of their motorcycles. The Marketing Dictionary defines perceptual maps as a â€Å"process by which consumers’ perceptions of an existing product are charted† (n.d., para. 1). In this paper the three phases of the simulation, the situation, recommended solution, and results will be discussed. In addition there will be a discussion on relationship between differentiation and positioning of products or services and the impact of the product life cycle on marketing. Phase I (2Ãâ€"01)Sales of the Cruiser Thorr are decreasing. This is so because the Cruiser Thorr’s target consumers are aging and their tastes have begun to outgrow the lifestyle that Cruiser Thorr symbolizes. In addition to this issue, younger consumers are more interested in lower priced motorcycles due to their lower personal disposable incomes and they do not indentify with Cruiser Thorr’s lifestyle image. This scenario wanted to determine the Cruiser Thor’s position in the market by choosing four relevant parameters that will reflect the highest potential. For phase I the parameters that were chosen were lifestyle image, services offered, price, and quality engineering. Lifestyle image was chosen since the image for the Cruiser Thorr was being outgrown by the aging target audience and was not identifiable with younger consumers. Since the Cruiser Thorr’s lifestyle image is set very high any vital information gathered will be highly useful to maintain that level of image so that it satisfies both an older and younger audience. Services offered was another parameter chosen because compared to their competitors the services offered by the Cruiser Thorr are limited. The more frills a product comes with, the more it may heighten the desire for it. The third parameter that was chosen was price. Price was chosen because for many consumers price is one of the most important factors in making a buying decision. Furthermore, it was stated earlier that younger consumers were more interested in lower priced motorcycles. Finding out how much is too much as well as how low can you go without diluting brand image will be important in determining the  appropriate price tag to spark consumer interest. The last parameter chosen was quality engineering. This was chosen because of the fact that the Cruiser Thorr will not be able to maintain a high brand image without this feature (University of Phoenix, 2004). The decision to use lifestyle image, services offered, price, and quality engineering were the appropriate parameters to use. The parameters that were chosen were fundamental to the perceptual map and gave the best perspective as opposed to the other options. Phase II The position of the Cruiser Thorr is determined by the perceptual map and this position has not helped sales. This scenario calls for the marketing manager to create a marketing plan that will either reposition the Cruiser Thorr or launch a new motorcycle. Upon researching threats and weaknesses of Thorr Motorcycles, the decision was made to launch a new motorcycle, the RRoth, which will grab the attention of younger consumers. With the new launch the marketing mix needed to be determined. The price for the new RRoth was set between $13,000 and $15,000. This price range was chosen because earlier surveys conducted showed that the younger consumers were more interested in lower priced motorcycles. The types of promotions chosen were sponsored events at Daytona, offering insurance and protection plans, free test rides, publicize through Hollywood films, and providing giveaway merchandise. These were all chosen because of the high amount of appeal these types of promotional methods would have on younger consumers. The places chosen to promote the RRoth were the internet (Manufacturer’s Web site), Dealers, and Distributors. These options were chosen because of the accessibility to younger consumers, especially the internet. The services chosen were training to dealers, customization options, and financial services. Training to dealers was chosen so that the dealers can provide detailed and accurate information about the products sold. Customization options were chosen because this would add to the cool and youthful image of the RRoth. Financial services were chosen because the younger consumers indicated an interest in financing options. Choosing to launch a new motorcycle turned out to be a good decision. The marketing mix options chosen were the most optimal for the formulation of a differentiation strategy. Phase III It has been a year since the marketing plan was implemented and it is now time to determine if the plans have or have not been a success. Consumer perceptions of the Cruiser Thorr and the RRoth have been surveyed and a perceptual map will show whether or not the marketing activities have been a success. The marketing manager has to interpret market research to plot brand attributes of Cruiser Thorr. In addition, attributes relevant to the RRoth need to be chosen and interpreted to create RRoth’s perceptual map. The Cruiser Thorr was rated in lifestyle image at 9 because initially this was rated very high. A nine would be most appropriate. For price a rate of 4 was chosen because consumers saw this particular motorcycle as pricey compared to other brands. A rating of 4 or 5 would be appropriate. Services offered are rated at a 7 because services for the Cruiser Thorr is limited compared to competitors but were revamped because of consumer response. A rating of 7 is most appropriate. Quality engineering was rated at 8 because consumers think that Cruiser Thorr’s engine is the best. A rating of 8 is very appropriate. The RRoth was rated at a 7 for lifestyle image because like other Thorr motorcycles consumers are already considering it a status symbol. The rating chosen was the appropriate choice. Price was rated at 8 because the RRoth is cheaper than the Cruiser Thorr in order to target a younger consumer. An 8 rating is appropriate. Cool was chosen for the RRoth because of the younger audience and a rating of 8 was chosen. A rating of 8 was most appropriate. Relationship between differentiation and positioning of products or servicesDifferentiation of product is according to Investopedia â€Å"a marketing process that showcases the differences between products† (Investopedia, .n.d., para. 1). Positioning of products is â€Å"the consumer perception of a product or service as compared to its competition† (Lake, n.d., para. 1). The relationship is that in order for a company to be a leader in that particular industry not only do they have to differentiate themselves from  the competition, but they must also secure a position in the market that when consumers needs need to be met, that company will be number one on the list in consumer’s minds. The repositioning of the product in the simulation is what I had expected. It was expected because one of the main issues was the changing perceptions of the consumers and there was nothing wrong with the physical product. Tastes were changing but the product was still of high quality. Like many companies they offered a fresh new product and for Thorr Motorcycles this attracted younger consumers. But they did not totally scrap efforts on the Cruiser Thorr and worked on revamping the image. Product Life Cycle The impact the product life cycle has on marketing is that business need to plan their products around the product life cycle. Knowing where the product is on the cycle, marketing strategies can be adjusted to maintain profitability. â€Å"A particular firm’s marketing mix usually must change during the product life cycle† (Perreault et al, 2004, pg. 270). In the simulation the Cruiser Thorr was in the decline stage of the life cycle as their sales were declining rapidly. The declining sales were because the older audience’s tastes were outgrowing the Cruiser Thorr and younger consumers were put off by the high price. Because Cruiser Thorr was in decline stage, a new motorcycle, the RRoth was introduced to the life cycle and aimed at a different target group to revamp sales and consumer perception. ConclusionThe perceptual map helped to determine consumer expectations for Thorr Motorcycles. Precise parameters were determined to hone in on exactly what they wanted and expected from the company. This ultimately is what enabled Thorr Motorcycles to reposition consumer perceptions back to where Thorr motors wanted. How Supreme Court Decisoins have affected American Society Essay

The Supreme Court has been given credit and blame for having a wide range of effects on society. The decisions that they have made on current and past issues have initiated change in American society. These changes have had both positive and negative results. The effects of their decisions have ranged from improving the status of certain ethnic groups to limiting the procedures of law enforcers and clearly defining the rights of lawbreakers. In essence, Supreme Court decisions have had a profound influence on the behaviors of citizens as well as the political structure of this nation. The decisions of justices have â€Å"altered behavior of political and governmental officials as well as a man walking down the street†(Miller 4). To understand the role of the Supreme Court in the American system then one must pay attention to the social impact of court decisions. â€Å"The supreme court has assumed the task (of)†¦enforcing a law known to all, of deciding what law ought to be and making any changes called for† (Knight 1). Decisions are made by the Justices from conflicting principles not because of the law, but because of an evaluation of what impact the decision will have on American society. The Supreme Court has had a greater important impact then any other government institution on society as a whole. The decisions have affected people’s behavior as individuals and social institutions such as the family and economy (Baum 318). The decisions of the Supreme Court justices have â€Å"affected the social behavior of people by influencing†¦(their) thinking and the structures in which they operate†(Baum 319). â€Å"Change is the primary characteristic of American Society† (Miller 4). Change must also exist in American law. As society progresses and changes, the Court must address injustices as a result of change and determine criteria for a particular decision (Miller 5). As stated earlier, the Supreme Court decisions have initiated both political and social change (Baum 319). The constitution was established for certain and definite purposes. However what the Founding Fathers did not account for was change (Miller 4). As a result the Supreme Court has adapted the concept of an evolving Constitution (Miller 5). It was necessary to redefine laws that were passed earlier to adjust to the changing society. Also, it was necessary as time progressed and the movement for equality grew, the Supreme Court need to reexamine the â€Å"narrow mindedness† of our Founding Fathers (Miller 5). Decisions were made that ensured persons regardless of gender, race or religion were all granted the rights and privileges entitled to them as United States citizens. The Supreme Court has been involved in making dramatic decisions concerning social issues. Several areas that have been affected by their opinions include: 1) civil rights, 2) religious activities, and 3) police policy and procedure (Kessel 194). Although the actual decisions had little impact on society, they would stimulate other actions for change and in turn make a difference in society (Baum 319). For example, the decision to desegregate schools would be the catalyst for the civil rights movement. The â€Å"Schemmp† decision as well as the â€Å"Roe vs. Wade† decision will fuel the use of religion as a political stance (Baum 319). To understand how influential Supreme Court decisions are it is necessary to examine what effect they have had on American society. One of the most monument decisions was the effects of Brown Vs. the Board of Education. This decision ordered the desegregation of school throughout the nation. Previous to this decision, Plessy vs. Ferguson set precedent that institutions such as schools or public facilities could be segregated based on race. The condition of this decision was that both facilities whether for Caucasians or African Americans must be equal in quality. When this condition failed to exist to be met it became necessary for these institutions become desegregated. Brown vs. The board of Education required that â€Å"school districts with separate school for Blacks and White students be desegregated† (Baum 305). Most of the states in the northern and western states conformed to this decision. However in the Deep South, were slavery had been an institution, the call for desegragation was not widely accepted. In addition, the Supreme Court had allowed an â€Å"open-ended delay† to desegregation. This allowed  school districts to â€Å"take their time in desegregating schools†(Baum 318). In the South â€Å"†¦desegregation†¦(did not occur)†¦ for a decade because school administrators resisted Supreme Court ruling† (Baum 318). Some districts took several more years and the use of congressional force to obey the ruling. The Courts helped to make desegregation possible. It also had an impact on the government’s feelings toward racial discrimination. These rulings demonstrated that government support of discrimination was unconstitutional. It also declared that there â€Å"needed to be efforts to achieve racial equality†(Baum 307). As stated earlier, the Supreme Court had been a contributor to social change. It would help to initiate the civil rights movement. â€Å"Once the civil rights movement became active, the Supreme Court took †¦ steps to protect it†(Baum 318). Their decisions, although they did not directly protect the movement’s participants, helped to strengthen the cause. In fact Supreme Court decisions in support of racial equality have been viewed as a motivating factor of civil rights revolution of 1950’s and 1960’s and also the improvement of the status of African Americans (Baum 318). Another influential decision of the Supreme Court judges concerned police procedures and policies. In Miranda vs. Arizona, the Supreme Court established new restrictions on search and seizure as well as required certain warnings must be read to a suspect prior to questioning by police officers or detectives (Wald 149). Under the Miranda ruling, police have to give â€Å"adequate and effective warning of legal rights and honor the suspects use of the rights†(Wald 155). This is to ensure that the suspect will understand the meaning of these rights and how they apply to him. It is also to ensure that the suspect does â€Å"what is in his best interest†(Wald 155). In addition the presence of a lawyer during questioning ensured that the suspect’s 5th Amendment right under the constitution is not violated. Prior knowledge of one’ s self interest would allow them t act in their best interest. Once the defendant is properly warned of his rights, he will be in a position to act in accordance to his interests in remaining silent and  requesting a lawyer. The suspect also needed to understand that he is in an adversary system that is not working in his interest (Wald 156). It was believed that the decision from Miranda vs. Arizona would foster successful law enforcement. The Miranda rights were required to decrease the rate of coerced confessions due to police brutality. It has had limited effects. The Supreme Court decision has fueled debates over the rights of suspects (Baum 306). It is believed by some that once a person commits a crime by breaking the law they are not entitled to additional rights. In addition, Convictions have been lost because of the expansion of defendant’s rights. â€Å"They were failed to be read their Miranda rights so they were released† (Wald 156). However the Miranda decision has helped to impose restrictions on how much force and intimidation tactics police officials can use on suspects. In an attempt to end mistreatment of suspects by the police, the Miranda decision makes sure that the suspect has a â€Å"real understanding† of their rights and that they are clearly stated (Wald 163). In an attempt to end injustices toward crime suspects, several states have also gone to further limiting and restricting police practices. Police officers have somewhat abided by these court-imposed restrictions. Those who have not have subsequently been faced with charges of violating a person’s civil rights and risk becoming a suspect themselves (Baum 306). The final Supreme Court decision that has had an impact on American society was the decisions concerning seperation of church and state. The Supreme Court of the United States has been a vigilant watchdog in preserving the separation between church and state called for by the Constitution. In 1962 the Court ruled in Engel v. Vitale on the constitutionality of public?school prayers (Gawrisch). Enthusiasim arose in 1963 following the Court’s decision in two historic cases, Abington v. Schemmp and Murray v. Curlett. The devotional use of the Bible and all forms of prayer were banned from public schools as a contravention of the Establishment Clause. Objective study about religion and reading of the Bible for its literary and historic qualities were not prohibited (Gawrisch). These decisions had an impact on policies adopted and enforced on a school district level (Birkby 109). While some schools initially ignored the ruling, most adhered to it. Over time federal government limited religious observances in public schools (Baum 306). Ironically, this was an attempt to ensure religious freedom (Birkby 110). As time progressed the Court reiterate their rulings in different cases. As recent as 1992 & 2000, decisions have been made restricting prayer at school ceremonies and sporting events (Baum306). Some may argue that eliminating prayer in school has only further damaged the educational process of students. Other believe it has had adverse effects on the students (Baum 318). Students have lost their ideas of morals, and virtues. They are unable to realize that there are consequences for their actions whether negative or positive in nature. However as a nation of diversity it is unfair for educational institutions to allow the practice of certain religious practices and not others. Again one must look at the constitution right of freedom of religion and that one must not be forced to exposure to religious practices they do not participate in. In fact court decisions on school prayer have been cited as an important stimulus for the emergence of religious rights as a political movement (Baum 318). It is an issue that has yet to be resolved and will continue as long as America remains a nation of diverse people with distinctive views on religion. In conclusion, the Supreme Court has been a contributor to social change. It decisions have influenced the behaviors and attitudes of Americans since its creation. Although some may not agree with their opinion, they are forced to abide. It fulfills its duty as the interpreter of the law. It is in deciding body on political as well as social issues. It opinions and decisions have had rippling effects through America’s history. It as helped to reshape and redefine America’s perspective on important social issues. Statement of Educational Goals and Philosophy It is often said that the first impression you make on someone is the most important. It can never happen again and usually is not forgotten. I believe this is true for education also. Kindergarten or preschool is a child's first impression of school. Whether that impression is a good or bad one it will affect the child through the rest of their schooling. I was fortunate to have a great first impression of school which helped me to decide to become a teacher. There are many reasons why I have chosen Elementary Education as my major. The biggest reason is not only because I have always had a love for children but also for learning. Ever since I was a little girl, I would sit in my bedroom and play school. I had my own chalk board and I would teach to an imaginary class. I was continuously trying to learn new things and am still doing that to this day. The vision that I have for my classroom is like most of the classes I was in when I was in elementary school. They were very colorful, full of books and art projects, and made you feel like you were at home. I will arrange the seats in clusters, in which two students will set beside each other and then they will face two other students. I believe that this is a less intimidating arrangement and allows the students to gain social skills The bulletin boards will have every students art work or projects hanging up. The room will be decorated according to what time of year it is. My supplemental materials will include extra books for the children to read, craft supplies, and anything else that I can find that will make learning more enjoyable for the students. Many political conventions have resulted form the global interest in creating oil pipelines through Afghanistan. Although Afg hanistan is not a world power, the fact that this country can provide access to rich oil and gas reserves has allowed Afghanistan to have influence over and even affect international diplomacy. To begin, it is important to understand the political history of Afghanistan in order to comprehend the current political tension and issues concerning this country. Afghanistan’s history is complete with numerous wars and invasions throughout various historical periods. Majority of these conflicts occurred because of a political Afghan leader’s desire to continue holding the state of power in the country or because of foreign invasion. Desire to maintain power becomes an issue in Afghanistan due to the multi-ethnic nature of the population1. To begin, â€Å"the location of Afghanistan astride the land routes between the Indian subcontinent, Iran, and central Asia has enticed conquerors throughout history†2. First, the Muslim-Arab conquests left Afghanistan a Muslim country in the late 7th century. In the following centuries Afghanistan was invaded from the north by Genghis Khan and later by the Moguls. The conquests up to the 17th century lef t devastated Afghanistan. However, authorities invested the majority of their interests in attempting to control the political power against rebellious activities preventing swaying them from focusing on social and economical forms as well as the development of the country. The first unified Afghanistan State was not established until 1747 by Ahammad Khan Durani.

Enterprise Resource Planning and Software Systems Essay

Hershey Food Corporation, the biggest manufacturer of candy products in the United States, decided to implement a new Enterprise Resource Planning system titled Enterprise 21 starting in 1996. The ERP system consisted of many different software systems. These systems included SAP AG, Manugistics, and Siebel systems. With the implementation of these software systems, Hershey believed its mass market candy business strategy would be emphasized. Hershey’s Expected Benefits of Enterprise 21 Hershey had many goals for Enterprise 21. In general, Hershey had a goal of upgrading and standardizing the hardware and software systems. In attempt to upgrade the hardware, Hershey moved from a mainframe-based network to a client-server network. This upgrade would allow for Hershey to use and share its information with people inside the company as well as distributors outside the company, a critical aspect of establishing good customer relationships. The upgrade and standardization of the software system was a much larger goal. The SAP system, which allows for communication within company functions, was to be installed with other software systems. Manugistics software system would be used to forecast production and scheduling. Manugistics would also be useful as a transportation management system. The benefit of this system would greatly lower inventory holding costs and transportation costs, the two largest expenses in logistics management. Hershey also decided to implement Siebel systems, which is designed to aid in establishing and maintaining customer relationships, as well as a measuring device of the effectiveness of marketing strategies. Hershey’s Implementation Approach The first part of Hershey’s implementation process started with the installation of a bar-coding system. A bar-coding system is necessary to improve logistic management by tracking inbound and outbound materials and products. Due to a modification of the SAP system, Hershey decided to move the target date of the installation of the system to April of 1999. This new date meant the company had only thirty nine months to complete the implementation instead of the forty eight months originally forecasted. Due to the delay of the implementation of the full SAP system, the Siebel and Manugistics systems were also delayed. Because of the delays, the implementation of the new ERP system immediately caused problems because by mid July, when Halloween orders were arriving, the system had just been installed. Due to Halloween orders already arriving, Hershey’s information technology personnel decided to implement the ERP system using the cutover strategy, a very risky approach where all systems go into affect all at once. This approach failed, causing shortages with distributors of Hershey products. These shortages lead to bad customer relationships with distributors which further lead to bad relationships with their customers. Hershey could have used a much better implementation approach by slowly implementing their new system. The cutover strategy caused great confusion for employees who both entered orders and communicated those orders to production facilities and to employees who filled orders in warehouses. Causes of the Problems and Who is Responsible There are many different theories on the causes of the implementation failures of Hershey’s ERP system. Many believed that the software systems were not functioning properly. However, this was not the case, as these systems were operating smoothly in different units of Hershey. I believe the cause was directly related to the failure to use the systems properly. Due to the rushed implementation of the system, training and education of the new system was not properly or thoroughly conducted. Employees were confused not only how to operate the system but also did not see how the different software systems fit together. With better education and training, employees would have been able to process orders much more effectively and efficiently. The knowledge we have that the SAP system, along with Siebel and Manugistics, was working properly in other regions takes away the ability to blame the software companies for this ERP system failure. The blame has to be put in the hands of the information technology managers, as they were the personnel that decided to implement this system at such a fast pace. However, business managers and executives should have raised questions about the training of employees and potential disasters this system can cause. After all, the goal of an integrated ERP system is to link the different aspects of a business and to increase the communication between employees. Although IT personnel made the implementation approach decision, executives and managers should have had a larger role in the process before changing operations drastically as their busiest season was quickly approaching. Impacts on the Hershey Organization The largest impact that the Hershey organization had to deal with was the effect on the customer relationships. In an extremely competitive and global business world, customer relationships are one of the most important aspects of having a successful business. As noted in the article, distributors were unable to receive Hershey products, which further affected their customer relationships. This lead to a loss of distribution warehouse space as well as shelf space in stores, which forced customers to choose substitutes. Conclusion Although Hershey suffered huge losses in 1999 and part of 2000, they rebounded strongly in 2000. The reputation of quality products is what I believe to be the reason for their comeback. Without Hershey’s prior strong reputation and strong customer relationships, Hershey would not have been able to recover from this ERP system failure. All companies should use this failure as a guideline when implementing new software systems. Corporations must cautiously implement their systems in a manner that allows proper employee training and production efficiency while still maintaining customer relationships.

Can you imagine your life without your family or your friends? Well, whether you agree or disagree, human beings instinctively tend to socialize with others. However, who would you spend more time with, is it your family or your friends? As we know we can’t live without either our families or our friends because they represent a huge part of our lives. In this essay we will compare and contrast between spending time with family and spending time with friends in terms of attitude, places and discussions. No one can deny that attitudes differ between spending time with family and spending time with friends. When we spend time with our families we tend to be intimate, gentle and responsible. Even our behavior is appropriate and our acts are limited. For instance, when we go out with our family to a movie or to a dinner, we won't be able to act foolish and we will be restrained from doing exciting stuff; as our actions will be judged by our family members. But when we hang out with our friends we feel less intimate, more crazy, and liberated , also our behavior becomes frizzy and we act our ages or even younger . For example, with our friends we can tell funny jokes to each other, knowing that none of them will be insulted or degraded because friends tend not to take things seriously. So that’s how our attitude differs. The places we hang out with family and friends are also different. The places where you head to with your family are calm, and not crowded, such as beaches, parks, family restaurants and family resorts. The places that we go to with our family to spend some quality time together. On the other hand the places where we go to with our friends are more crowded and full of life like; movie theatres, shopping malls and night clubs. With friends we go to places that allow us to have fun and enjoy our time as much as possible. That's how the places that we go with our family and friends are different. Another difference is that the topics that you discuss with our family and the ones that we discuss with our friends are dissimilar. For instance, with your family you talk about what happened with you when you were in a particular place on a particular day. Also, you discuss more mature topics that benefit you like; how to manage time, which university to apply for, how to invest your pocket money and open an account in the bank so that you can use it in emergencies, how to solve complicated problems and many other things that are beneficial for you. By contrast, with your friends you discuss topics that you have common interest in, such as; fashion, movies, study, work, simple problems and other things that may be immature and non beneficial for you. And that’s how the discussions contrast among family and friends. Finally, our attitude differs from being with our families than being with our friends similarly with the places that we visit or the topics that we discuss. However, it’s the undeniable fact that we can never live without our families or our friends.

The United States Constitution has been amended since its origination. These amendments are meant to help our Nation adjust to the ever changing times. Our Bill of Rights is contended in the first ten amendments. The Bill of Rights is instilled into our constitution to protect the citizens of the United States from unfair and unjust treatment by their own government. Our government is protected and enforced through local police departments and our Bill of Rights gives certain freedoms to the citizens and suspect of the police prior to and during prosecution by the criminal justice system. From arrest to sentencing, the Bill of Rights protects us. This paper will specifically discuss the fourth, fifth, and sixth amendments of the Bill of Rights and how they pertain to both juvenile and adult court proceedings. The Bill of Rights also governs the government by placing limits to the extent of their reach, or power, and how that power is used against its own citizens. The Bill of Rights, or ten amendments, took adoption into our Constitution in 1789 by the efforts of James Madison. Fourth Amendment Our Fourth Amendment guarantees protection from unreasonable or unlawful search and seizure. This particular amendment is a component of the Bill of Rights that gives citizens the right to secure their persons, belongings and homes; each of which are protected under the Fourth Amendment from any unreasonable or unlawful search and seizure. The bill strongly states that this right shall never be violated as well no warrants shall be issued, unless there is a probable cause, which has approval by an oath of affirmation and the description of the place under inspection, the affected person or the possessions to be seized. In both juvenile and adult courts, the constitutional safeguard is applied (Emanuel 2009). Both juvenile and  adults are afforded this right by our Constitution to be free from harassment that is not been approved by the law with stated warrants specifying the desire and description of objects to be seized. If this right is violated in any way it is most likely the v iolator would face criminal charges or consequences due to their actions for denying citizens their Fourth Amendment right. Fifth Amendment Our Fifth Amendment discusses due process, self-incrimination, double jeopardy and eminent domain. Sixth Amendment Our sixth amendment discusses the right of trial by jury, the rights of the accused, the right to a speedy trial, the right to an attorney, and the right to a public trial. The Sixth Amendment states that any subject suspected of criminal activity resulting in prosecution will have the absolute right to a speedy trial by public and of a jury of their peers (Abadinsky, 2008). All subjects or suspects shall be informed of the charges against him/her regarding any arrest of criminal activity, witnesses are also available to testify for and against the accused according to the Sixth Amendment and the accused will be given witnesses prior to jury trial,  this right is afforded to citizens under the Sixth Amendment of our Constitution. The suspect will have the right to have his/her own witness as well as a presentation of defense by his/her attorney in order to conflict with prosecutor evidence given against him/her. Our constitution affords the right to be given a fair, speedy and public trial in both juvenile and adult criminal court proceedings. Not only do they have the right to a fair, speedy, and public trial; but they are afforded the right to legal representation for any offense brought to the criminal justice system. This ensures the rights of the accused to place defense upon any mistaken identities or statements of the facts regarding the crime in which they have been charged. The right to a speedy trial gives the accused the ability to precede with his/her normal life without undergoing a long drawn out process of the court system inflicting undue influence on their lives. Delay of justice may bring a lot of frustrations to the accused, thus, the speedy and public trial is a great variant (Wilkerson 1973). Lots of decision making goes into this process which is affected by mental models, personal bias and stereotypes that consistently influence the decision makers during statistical computation (Jarret 2009). This does not mean that decisions made are effective sometimes they can be flawed as well. In fact many times the greatest obstacle in the way of innovative change is the flawed human judgment. For example, mergers largely fail to achieve potential. Failure in achieving an effective change can be due to many factors like lack of vision, poor processing, inappropriate business strategies etc. but being able to manage a flawed judgment is the key to survival. Change has to be strategized in a way that leads to successful future yet satisfies short term requirements (Holbeche 2006). Theories of Innovation and Change Different theories about innovation have been brought by different scholar that are being seen practically implemented on to this world such theories as presented by Max Weber, Nisbet, etc are important to be discussed so that change innovation can be well comprehended. With the existence of social science there have been untimely diverse changes in the society. The theory that emerged from Robert Nisbet was the first time people started noticing that there is link between change and society with its past and the present, and here started a new debate. Nisbet’s thesis presented the fact that there can be no reflection or study upon the social change evolving hence it is not measurable and it is distinguishable from the intellectual activity which is usually referred as history (Boudan 1986). Revolution can be defined as a social change that place within a very short period of time. Social change is made up of four factors that are; Modernization, Diffusion, cultural lag and indigenously initiated alteration within the systems. When society is not able to cope up with the forced factors that have been involved into it, change s in that society are inevitable and thus revolution comes into that society.
